POINTS-TESTED SKILLED SELF-DE VISA (SUBCLASS 189) STREAM

REQUIREMENTS FROM THE STATE FOR 190 VISAS (2023–24 YEAR)

A skilled worker may live and work in Australia as a permanent resident under the points-based 190 visa if they are nominated by an Australian state or territory government. Candidates must first successfully receive a nomination from a state or territory authority in order to apply for the visa subclass 190. It is important to keep in mind that, in addition to the minimal standards established by the Department of Home Affairs, each state and territory has its own set of conditions that all candidates seeking nomination must satisfy. It might be challenging to navigate state and territory requirements.

To help you better understand what needs to be done to improve your chances of receiving invites, we have summarised the basic requirements of all states and territories in this post.

Allocations of state and territory-nominated visas (2023–2024)

The following nomination levels have been assigned for 2023–24 (in relation to the prior financial year) after consultation with States and Territories:

190 visa requirements for New South Wales

Those who wish to apply for the NSW state nomination must:

  • be younger than 45 years old.
  • possess a favourable skill evaluation in a profession listed on the NSW Skilled Occupation Lists for a 190 visa.
  • possess at least a proficiency in English. It is not necessary for citizens of the United States, United Kingdom, Canada, Republic of Ireland, or New Zealand to finish an English assessment.
  • being a resident of NSW at the time. EOIs sent in from people who are currently residing offshore or in another Australian state or territory will not be accepted by NSW.

NSW nomination is difficult because there have been so many applications over the years. To maximise your chances of being nominated, you must raise your points as much as you can.

Candidates from overseas: NSW 190 visa

Offshore candidates with skills in some ANZSCO unit group occupations are now qualified for NSW nomination.

Please take note that in order to qualify as an offshore applicant, you must have lived abroad for the previous three months without interruption.

Work experience is necessary for a NSW 190 visa.

All occupations within specific ANZSCO unit categories now require a minimum of three years of work experience in the nominated (or closely comparable) occupation. These modifications are applicable to all onshore and offshore SkillSelect EOIs, regardless of when they were submitted or modified.

Victoria will choose applicants for the subclass 190 visa in all eligible occupations in addition to those who reside in Victoria and those who reside outside of Australia.

Applicants for the subclass 491 visa may also be located outside of Victoria, while Victoria currently gives preference to nominations for health occupations for the subclass 491 visa.

Australian Capital Territory requirements for visas

The Australian government has instructed ACT to propose candidates who can aid in the post-COVID economic recovery. The following requirements must be satisfied before you submit an application for the nomination.

  • Resided in Canberra for a minimum of six months.
    • the first of the following
    • The ACT Critical Skills List includes the nominated occupation, OR
  • an employer in the ACT who is the major sponsor of a subclass 457/482 visa:
    • You have at least six months of work experience for the sponsor in Canberra.
    • At the time of the nomination application, the visa must be valid for at least 12 months.
  • Must be employed full-time (for a minimum of 35 hours per week) by an ACT employer in Canberra for at least six months.

West Australian 190 visa requirements
  • Migration WA has temporarily changed many of the requirements for its skilled state nomination programme, including:
  • newly added professions on the qualifying lists
  • the $200 application fee is not charged
  • reducing the duration of the work contract from 12 to 6 months
  • lowering criteria for applicants to show they have enough money
  • removing further English language requirements for manager and professional positions, and
  • lowering the need for work experience for the 2022–2023 programme year to 6 months
Northern Territory requirements for visas

The online application system now accepts onshore applications for Northern Territory nomination under the General Skilled Migration programme. While the national border restrictions are in force, offshore applications are still not accepted.

Queensland’s 190 visa requirements

Migration The state-nominated skilled migration programme for 2023–24 has begun in Queensland. Queensland had gotten a much less number of slots for this programme year than had the other states and territories.

In order to ensure an evenly distributed workload throughout the programme year, Queensland will start inviting selected applicants at the end of this month and hold invitation rounds at the end of each month.

South Australia’s 190 visa requirements

On July 20, 2021, South Australia will launch its skilled immigration programme for this fiscal year. South Australia has announced its amendments to the migration programme, with a total of 5,200 slots given for both 190 and 491 nominations.

  • Applicants living in Australia but not in South Australia are now eligible for the South Australia under Talent and Innovator Employment Stream Depending on their specified occupations, offshore applicants are qualified for South Australia state nomination.
  • There are three main streams: the Talent and Innovators Programme, International Graduates, and those who are presently residing and working in South Australia.
  • In rare cases, candidates are eligible to file for the state nomination even though they do not currently hold the position they have chosen.
