VISA FOR ADOPTION (SUBCLASS 102)

Adoption Visa: This visa allows an overseas adopted child to live with their adoptive parents in Australia.

ADOPTIVE PARENTS NEED TO BE:
  • Australian national
  • a person with a permanent resident visa for Australia
    a citizen of New Zealand who qualifies

Who is eligible and who can obtain this visa

Usually, an adoptive parent will apply for this visa on the child’s behalf.

The youngster must: in order to be eligible for the visa.

  • being under the age of 18
  • reside outside of Australia
  • be either adopted by their sponsor currently or be in the process of being adopted
  • fulfil the requirements for character and health
  • The child will not be qualified for this visa if they are under the age of 18 at the time of application but will turn 18 before the application is decided.

The adoptive parent who is sponsoring the child must also be:

  • a national of Australia
  • the holder of a permanent resident visa for Australia, or
  • a suitable citizen of New Zealand

If it is not in the best interests of a child under the age of 18, this visa will typically not be granted.

​Health

Certain health requirements must be met. Typically, the outcomes are good for 12 months. This also holds true for any family member listed on your application, regardless of whether they are moving abroad.

​Character

A youngster who is older than 16 years old must adhere to specific moral standards. Once they became 16 years old, they had to be ready to present a police certificate from each country they had lived in for at least a year in the previous ten years. Concerning the adoption visa

Note: As of December 14, 2015, the Department will no longer accept applications for adoption visas for kids who were adopted in Pakistan. This nation is mentioned in a piece of legislation.

You won’t be able to submit a legitimate application to the Department for an adoption visa for the child if you are planning to adopt a child from Pakistan or have already adopted one.

State and territorial welfare bodies are given the authority to act as guardians.

If any of the following occurs, the minister ceases to be the guardian:

  • The child gains citizenship in Australia.
  • the child reaches the age of 18
  • For the child, an Australian adoption order is made.

​Sponsorship commitments

You must concur to the following as the sponsoring parent:

  • be liable for the child’s living expenses as incurred by the Australian government
  • for the child’s first two years in Australia, give suitable lodging and sufficient financial support to cover their basic living expenses.
  • assist the kid in settling in Australia
  • encourage the kid to go to any compulsory English classes
