TEMPORARY CONTRIBUTORY VISA FOR AGED PARENTS (SUBCLASS 884)

Overview
  • With this visa, you may:

  • Work and study in Australia without getting financial aid from the government

  • the Permanent Contributory Aged Parent (subclass 864) visa application
  • You must be 65 years old or older to qualify for an Australian Age Pension.
Primary criterion

Parents with children who are permanent residents or citizens of Australia who are “settled” in Australia may apply for a Parent Visa through the Australian Department of Home Affairs. According to regulations, a person must have “settled” by living in Australia for a sufficient amount of time, which is often two years.

The applicant must pass what is known as the balance of family test in order to be eligible for this visa. According to this requirement, the applicant must have more of their children living in Australia than any other country, or at least half of their children must be Australian citizens or permanent residents. The balance of family test takes into account all children, including stepchildren and adoptive children of both parents.

You must also pass the health and character standards in addition to the balance of the family test, be sponsored by an eligible person—typically your child—and complete all other requirements.

Visa types

Permanent Subclass 864 – This type of visa, known as a “Contributory” visa, is perpetual. Due to the fact that the initial application charge is $4,765 for the first applicant, $2,380 for additional applicants over 18, and $1,195 for extra applicants under 18, the initial application fee is also the highest. The second installment for every application, however, is $43,600. We predict it will take at least 12 years for new Contributory Parent visa applications that are submitted and meet the requirements to be released for final processing.

The sizeable “Contribution” that is required with the second instalment is intended to make up for the rights granted to visa holders under permanent residency, such as access to health care, for which they have not paid taxes throughout their lives as have regular Australians.

Subclass 884 (Temporary) – This is a temporary visa; the Australian government charges an initial fee of $4,765 and a subsequent applicant fee of $2,380. The second installment of $29,130 must be paid before the visa may be issued. The applicants are given a temporary visa good for two years. They must pay an additional $19,420 and submit an application for the permanent visa subclass 864 before this visa expires. We predict it will take at least 12 years for new Contributory Parent visa applications that are submitted and meet the requirements to be released for final processing.

In every case, the second payment of funds is only necessary if all applicants have completed character and health checks and the AoS (Assurance of Support; see below for details on the AoS) has been filed with the Australian government. A second installment will never be paid and a visa won’t be issued. Second installments are never refundable.

Fees

The following fees apply to Permanent Parent Visas; please note that all payments are in Australian dollars (AUD) and that  Baysis Group fees must be paid in full before your visa application can be submitted.

As mentioned above, you can apply for the temporary parent visa (subclass 884), which is valid for two years, and then apply for the permanent visa if you want to stagger the process. The benefit is a reduced second VAC charge of $29,130. Two years later, at the permanent stage, a second payment of $19,420 is due. The visa holder may reside in Australia as the holder of the category 884 visa once the first stage has been accepted.

AoS, or assurance of support

There is also an AoS that must be paid at the time of decision. In the present, this costs $14,000 for two applicants. Ten years after your arrival in Australia on a contributory parent visa, you will receive your bond back, less any outstanding debts to the Australian government.

Temporary visas

You may be awarded a Bridging Visa “A” (BVA) if you are in Australia as the bearer of a valid visa (such as a Visitor visa) and you apply for a Contributory parent visa (subclass 884/864). You can stay in Australia legally while your visa application is being reviewed thanks to the BVA.


Your BVA might expire if you travel outside of Australia (depending on your circumstances), in which case you might not have the “right of re-entry” into Australia. Therefore, you might need to first obtain what is known as a Bridging Visa “B” (BVB) if you need to travel while your visa is being processed. While your application is being processed in Australia, the BVB will permit a certain amount of travel. Three (3) months is the normal amount of time that is permitted for travel while an application is being processed. During the duration of your bridging visa, you have complete working rights.

Medical Insurance

Both temporary and permanent visa holders with Subclass 864 (permanent) status are eligible for Medicare, a domestic health insurance programme. You might receive a Medicare card if you’ve applied for a Contributory Parent Visa. You are not eligible until your permanent Contributory visa is granted if you applied for the permanent Contributory visa without first obtaining the temporary Contributory visa.
