SUBCLASS 859, GLOBAL TALENT VISA -EMPLOYER SPONSORED (GTES VISA)

The Global Talent programme (company sponsored)—subclass 859—is a permanent visa designed to draw the smartest and brightest people from throughout the world. With the continuation of the Global Talent – Employer Sponsored programme (GTES), formerly the Global Talent Scheme, Australian businesses and start-ups will have easier access to the greatest and brightest talent from across the world.

The government acknowledges that there is intense competition for high-tech talent and abilities on a worldwide scale and that luring these individuals helps to transmit skills to Australian workers and expand enterprises with an Australian focus.

The Global Talent Programme will have two parts. Businesses that have been in operation for at least four years and the start-up stream are considered established.

The Temporary Skill Shortage Subclass 482 was the previous classification for the Global Talent Scheme visa, which offered the possibility of permanent residency after three years of employment.

The Global Talent Scheme LMT

The time frame within which LMT is required

When requesting a GTS agreement, you must present proof of LMT. For each specific vocation sought under the GTS agreement, proof is required. No additional LMT for these vocations will be required during the 12-month pilot period (until June 30, 2019). During the pilot period, no evidence will be required at the nomination stage of the visa application procedure.

Before additional occupations can be added to a GTS agreement, you must show proof of LMT if you want to add them by way of a deed of variation.

Indicators of LMT

For each particular occupation, you must show proof of two attempts to hire qualified and experienced Australians. Two components of the same general technique may be included in this. For instance:

Explain these facts in the GTS request form you submit to the Department in cases where it is impossible to show evidence of two tries, such as when there is a very small worldwide pool of qualified individuals and the LMT techniques indicated below are not appropriate.

If given permission by the employer, a third party (such as an affiliated entity or a contracted party, such as a recruitment agency or executive search firm) may carry out LMT.
