A visa for orphans (subclass 117)

If a child’s parents have died, are incapacitated, or cannot be located, they may be entitled to move to Australia to live with a relative under the terms of the Subclass 117 Visa, generally known as the Orphan Relative Visa. With the help of this visa, the youngster would be allowed to live permanently in Australia and pursue both job and education there. He or she must help the child as a sponsor by offering housing and financial support for the first two years the youngster is in Australia.

Siblings, grandparents, aunts and uncles, and the present spouse or de facto partner of the child’s relative are all examples of qualified relatives. The relative must also reside permanently in Australia. Typically, the term “settling” refers to a person who has been residing legally in Australia for at least two years. If the sponsor or the sponsor’s partner has been accused of crimes involving children, the case officer will also take that into account when deciding whether to grant the visa.
