VISA FOR PARTNERS (SUBCLASS 309 & 100)

The spouse or partner of an Australian citizen, an Australian permanent resident, or a qualified New Zealand citizen may live in Australia under the terms of the Partner visas (subclasses 309 and 100).

You are first awarded a temporary partner (provisional) visa (subclass 309) that allows you to remain in Australia while your application for a permanent partner (migrant) visa (subclass 100) is being handled.

Eligibility

You must be wed to, or in cohabitation with:

  • a national of Australia
  • a permanent resident of Australia
  • a qualified citizen of New Zealand.

According to Australian law, your union must be legitimate. This means that if you are 16 or 17, you need parental consent.

You must have been de facto for at least a year before applying.

Duration of stay

You can remain on the transitory 309 visa until a determination is made on your long-term Partner visa (subclass 100).

You can stay indefinitely if you have a permanent 100 visa.

The Process

The permanent Partner (Migrant) visa application process (subclass 100) consists of two steps. You first need to be awarded a temporary Partner (Provisional) visa (subclass 309) in order to be qualified for a permanent partner visa. Permanent and temporary visa applications are submitted simultaneously, and just one fee is required. Approximately two years after submitting your application, if you are given the temporary Partner (Provisional) visa (subclass 309), you are eligible to be evaluated for the permanent Partner (Migrant) visa (subclass 100). Additional documents are required for this assessment.

The permanent Partner (Migrant) visa (subclass 100), which is awarded right after the temporary Partner (Provisional) visa (subclass 309), will be granted if you were in a committed relationship for a significant amount of time prior to submitting your application.

Long-term partnership

If you are in a long-term relationship with your partner at the time of application, the permanent Partner visa (subclass 100) will be issued after the temporary Partner visa (subclass 309).

Eligibility
Age

When applying, you typically need to be 18 or older if you’re married. This is due to the fact that under Australian law, you must be 18 or older for your marriage to be legally binding.

When applying, de facto partners must be at least 18 years old.

Your partnership

You must be a de facto partner, spouse, or spouse (married) of an eligible Australian citizen, Australian permanent resident, or citizen of Australia.

Even if your relationship ends after you submit your application, you can still be qualified.

Sponsor

Unless your partner is a minor, you must have a sponsor who will also serve as your partner.

Health

You must be in good physical condition.

Character

The character criteria must be satisfied.

Government of Australia debts

You must have paid off any outstanding debts owed to the Australian government or made arrangements to do so.

You have to

  • possess a short-term Partner visa (subclass 309)
  • Unless your relationship with your spouse or de facto partner ends,
  • partnership terminated, there are unique circumstances, and while on your temporary visa, you complied with all Australian rules.

Your children will have the same privileges and visa restrictions as you if you are given the visa.

You and your kids must abide by the terms of your visa as well as Australian law.
