TSS 482 VISA (TEMPORARY SKILL SHORTAGE VISA)
The TSS visa allows employers to hire skilled workers when they cannot find suitable Australian candidates to fill labor shortages. It allows the employment of foreign workers to address temporary skill gaps while ensuring that Australian workers are given priority.
If a company is unable to employ an Australian citizen or permanent resident to perform the skilled work, they may sponsor an individual for this visa. To sponsor you under the TSS visa, the company must be a Standard Business Sponsor (SBS) or an Overseas Business Sponsor (OBS).
The TSS 482 visa involves a three-step process:
Step 1: The employer must submit a sponsorship application; the employer must be a legitimate, active business that complies with local labour and employment laws.
Step 2: The nomination application is the next step in the application process. This relates to the position that needs to be filled, salary information, efforts to hire Australian workers, and the ‘genuineness’ of the position.
The third step is for the nominated employee to apply for a visa. The visa applicant must provide proof that they meet the qualifications for their profession, as well as the standards for fitness and moral character.

3 Streams
Under the TSS 482, three streams are available:
The Short-term Skilled Occupation List (STSOL) contains occupations that require genuine temporary foreign skilled workers for a maximum of two years at a time (or up to four years if an international trade obligation applies).
Employers may use the medium-term stream to find highly qualified foreign workers to fill positions that are on the Regional Occupations List (ROL) or the Medium and Long-term Strategic Skills List (MLTSSL) for up to four years (each time), with eligibility to apply for permanent residence after three years.
On the basis of a demonstrated need that cannot be satisfied in the Australian labour market and the inaccessibility of standard visa programmes, employers may use the Labour Agreement stream to find overseas skilled workers with the option to negotiate permanent residence.

- were in Australia as the holder of a SC 482 visa in the Short-term stream for periods that total at least 12 months between 1 February 2020 and 14 December 2021; and
- make that further application before 1 July 2023 unless the Minister specifies a later date.
- IELTS overall 5 (no skill below 4.5) or equivalent, unless exempt
- NO permanent residency pathway unless regional
- Show intention of temporary stay (GTE requirement)
- 2 years of relevant work experience required and meet ANZSCO requirements
- No age limit
- Occupation on the Regional Occupations list (ROL)
- Employer must be in a designated regional area
- Renewable onshore and unlimited times
- Pathway to permanent residency through the 494 visa
- IELTS 5 (no skill below 5) or equivalent, unless exempt
- 2 years of relevant work
Employer TSS 482 Visa SAF Levy
An employer must pay a training contribution charge (also known as the Skilling Australians Fund levy) when they sponsor employees for a TSS 482 visa:
Businesses with annual revenue of under $10 million will need to make)
- Businesses with annual revenues of less than $10 million must)
Businesses with turnover of $10 million or more per year will be required to make:
- a $1,800 yearly up-front payment for each worker with a TSS 482 visa
Testing the labour market (LMT) for TSS
Before hiring an international applicant, employers must advertise the position on two national platforms (unless an international trade obligation applies). This is to make sure that before hiring an overseas skilled worker on a TSS 482 visa, employers look for an Australian with the necessary qualifications.
Pay scale for TSS
To ensure that international workers are protected and the local labour market is not undercut, sponsors looking to hire an international worker must show that they intend to pay the market salary rate. It must, in any case, be higher than the TSMIT (Temporary Skilled Migration Income Threshold). superannuation (as of 1 July 2023).
Caveats
Some occupations are subject to caveats that set a minimum remuneration level that is above TSMIT. For example the occupation of “Marketing Specialist” or “Conference and Event Managers” excludes positions which have nominated annual earnings of less than AUD65,000 or for example the occupation of “Corporate Services Manager” will require the business to have turned over at least AUD 1 Million in the 12 months prior to the nomination application.
The TSS 482 visa (Employee) requires applicants to have work experience.
To qualify for a TSS visa, applicants must have worked in the nominated occupation or a related field for at least two years. As a result, if you have recently earned a relevant Bachelor’s degree from an Australian university, you would typically not be eligible for the TSS visa unless you also have another foreign qualification and two years of work experience.
What is condition 8607?
Condition 8607 applies to all primary TSS visa holders. It is similar to condition 8107, which was applied to subclass 457 visa holders. Condition 8607 requires TSS visa holders who wish to change occupation (as opposed to employer), to have a new nomination approved and a new visa granted before they start work in a new occupation.
Repeat TSS 482 visas
In general, all applicants for a TSS 482 visa (i.e. primary and secondary) can either be inside or outside Australia. If the application is for a Short-term (ST) stream visa, however, the primary visa applicant must be offshore if all of the below apply:
- they have held more than one ST stream TSS 482 visa
from subclass 457 to TSS transition
- Under the TSS visa programme, employers who have already been approved as standard business sponsors for subclass 457 may sponsor skilled foreign workers.
- In order to apply for a TSS 482 visa, secondary visa applicants (of 457 visa holders) must submit a subsequent dependent TSS application.
Some consequences of this:
- The STSOL list includes jobs like cook and restaurant manager. However, unless your name is added to the
- MLTSSL list or you are in a designated regional area and on the TSS ROL list, you can no longer apply for a permanent visa. However, you can still be sponsored for 2 years by a restaurant on the 457 visa and receive a second 2 year extension.
